On January 9, 2024, a gunsmith near Rouen was robbed by three armed individuals. Out of fear, the gunsmith shot the robbers and killed one of them. This is where his ordeal began. How will he be able to prove that he was acting in self-defense? What is self-defense? Pierre-Marie Sève, from the Institute for Justice, explains what the law says.

⚠️ Reminder: A proportionate response means that the defense must be proportional to the seriousness of the attack, meaning that the act committed in self-defense must be equivalent to the act suffered, or conversely, avoid disproportion between the means of defense employed and the seriousness of the attack. For example, a neighbor who alerts the police about a nighttime disturbance and then uses his firearm when drunk individuals approach within a meter of him, after having repeatedly entered his property to commit vandalism and intimidation, is using a proportionate means of defense (Cass. crim. 21/02/1996, no. 94-85.108).
