🔍 In a landmark decision, the Madhya Pradesh High Court has reignited the debate on marital rape by ruling that a man engaging in unnatural sex with his wife does not amount to rape under Indian law. During the hearing, the court opined that Marital rape is not recognized in Indian law. Therefore, a husband engaging in anal sex with his wife, even without her consent, does not constitute rape.
📆 Case Background: The case dates back to 2019 when a wife filed an FIR against her husband, alleging unnatural sexual acts after their marriage. The husband moved the High Court challenging the FIR and requesting to quash it, arguing that any instance of unnatural sex between him and his wife would not amount to an offense under Section 377 of the IPC.
🗣️ The ruling has sparked reactions from women's rights activists and legal scholars, highlighting the urgent need for legal reform and social change regarding marital rape in India.
