Aggravated Assault in Texas: Facing Charges in North Texas? Learn the in's and out's of what the Government must prove in order to establish the charge of Aggravated Assault Deadly Weapon. In order to prove the charge, the State of Texas must prove beyond a reasonable doubt one of the following?

1. Aggravated Assault Serious Bodily Injury - You allegedly assaulted someone and the action caused the person to suffer serious bodily injury. What is serious bodily injury? The law says they suffered a permanent loss or protracted loss of the use of a part of their body. Example – they are permanently crippled

2. Aggravated Assault Deadly Weapon – If someone claims you caused a person injury by using a deadly weapon. What is a Deadly Weapon? This can be anything used that its intention was to cause serious bodily injury or death. It can be a car, it can be pencil if someone tries to stab them in the eye but more commonly it is a knife or a gun.

3. Aggravated Assault by Threat – if you are just holding a Deadly Weapon but the alleged victim claims that they were in fear of serious bodily injury or death, you can also be charged. Watch this video for examples of how difficult it can be to prove this type of Aggravated Assault.

No Bill by a Grand Jury – after watching this video, you will see that there can be times when there is very little evidence to establish an arrest for Aggravated Assault Deadly Weapon.
