The United States Supreme Court gave property owners in hot water an avenue for judicial review under the Administrative Procedure Act in Sackett versus E P A.
The Sacketts owned a residential lot in Idaho. While preparing to build a home, the Sacketts filled a portion of the lot with dirt and rock.
Several months later, the Sacketts received a compliance order from the Environmental Protection Agency, or E P A. The order concluded that the lot was subject to the Clean Water Act because it contained wetlands adjacent to Priest Lake. The order required the Sacketts to restore the lot according to an E P A work plan. Failure to adhere to the order’s terms risked daily fines of seventy-five thousand dollars.
After the E P A denied their request for a hearing, the Sacketts sued. The federal district court dismissed the suit for lack of subject-matter jurisdiction. The district court concluded that the compliance order wasn’t a final agency action entitled to judicial review under the Administrative Procedure Act, or A P A. The Ninth Circuit affirmed. The United States Supreme Court granted cert.
