So to speak, at the end of the year, legislators decided to please us with a new batch of changes that, one way or another, affect motorists. These changes and innovations will be discussed in today's video.
And I'll start, perhaps, with the deprivation of rights for taking dangerous drugs.
Amendments to the legislation have already been developed. And according to them, traffic police inspectors will be able to issue decrees to drivers, ranging from fines and up to deprivation of rights, for taking a number of drugs that affect the perception of reality while driving. Among the popular medications for which a driver can be deprived of his license are: "Tedein", "Teraflu", "Fervex", "Solpadein", "Nurofen Plus", "Spazmalgin", "Suprastin", and, of course, "Validol", "Corvalol", "Valoserdin" and several other medications.
But fortunately, for now, the introduction of these amendments was frozen, at the request of the Constitutional Court, in early December, and all because the previous wording was recognized as unconstitutional and inaccurate.
As an example of where there was a gap that prevented administrative liability for driving a vehicle while intoxicated, I will take the following norm, "when, according to the results of a medical examination for intoxication, substances included in drugs that are not related to ethyl alcohol, narcotics and psychotropic substances, but can impair his attention and reaction, are found in the driver's body." And it turned out that ultimately there was a risk of ambiguity in the interpretation and contradictory application of this note in proceedings on administrative violations in the field of road traffic.
New clarifications developed by the Ministry of Internal Affairs should eliminate the gap that has formed. But until the document is adopted, the State Traffic Safety Inspectorate was recommended not to initiate cases against drivers in whose bodies traces of drugs not included in the list of narcotic and psychotropic substances were found.
