How to Handle Documents Without Notary Certificates
Notaries should never decide the notarization type for signers. If a signer doesn't know or the document is missing the certificate, take these steps.
In this video, we’ll share what you can do when the Notary certificate is missing from the document you’re asked to notarize.
If a signer is unsure of which notarization they need, you may describe the different types of notarizations. For example, you can explain the difference between acknowledgments and jurats. Then, let the signer decide.
If the document is missing the Notary section, you may advise the signer to contact the issuing or receiving agency of the documents for guidance. If the agency can’t help, the signer may need to consult an attorney.
Remember, you may not provide legal advice if you’re not an attorney. While you may explain the differences between the types of notarial acts, saying “Most power of attorney documents I notarize require” is considered unlawful practice of law.
Engaging in unauthorized practice of law may lead to criminal charges and, in some states, result in the loss of your Notary Public commission. If you provide incorrect advice that causes legal issues, you may also be required to pay substantial damages in a lawsuit.
