Carpenter v. Double R Cattle Co., Inc. | 669 P.2d 643 (1983)
Adrian Carpenter lived near a cattle feedlot run by the Double R Cattle Company. When the feedlot expanded its operations, Carpenter’s property endured toxic smells, air and water pollution, noise, and pests, all caused by feedlot activity. Could Carpenter require the feedlot to abate the nuisance, or at least compensate him for the harm? That’s the question in Carpenter versus Double R Cattle Company.
Carpenter and other neighboring homeowners sued Double R. Carpenter alleged that the expanded feedlot was a nuisance and requested damages and injunctive relief. The trial court instructed the jury to weigh Carpenter’s alleged injury against the feedlot’s social utility, accounting for the interests of the community as a whole, to determine whether the feedlot was a nuisance. The jury concluded that no nuisance existed. The trial court entered judgment for Double R. Carpenter appealed to the Idaho Court of Appeals, arguing that the jury instructions misstated nuisance law.
