Capron v. Van Noorden | 6 U.S. (2 Cranch) 126 (1804)
It’s blackletter law that federal courts are courts of limited jurisdiction, allowed to hear only certain types of disputes. But whose responsibility is it to establish jurisdiction over a specific dispute? Over two centuries ago, the United States Supreme Court considered that question in Capron versus Van Noorden.
Capron sued Van Noorden for trespass on the case in federal court in North Carolina. Capron’s pleadings alleged that Van Noorden was from Pitt County but didn’t disclose Capron’s citizenship or place of residence. The circuit court didn’t establish its jurisdiction but proceeded with the trial. The jury found for Van Noorden, and the circuit court entered judgment. Capron sought a writ of error, which the United States Supreme Court granted.
