Around 8 million tonnes of plastic waste is disposed of in oceans endangering the marine habitats;
Further, According to the 2020 Report of the Central Pollution Control Board, India generated 1,014,961 tonnes of e-waste in FY 2019-2020 – which is up by 32% from FY 2018-2019.
These figures and statistics reflect the gradual increase in the pollution generated, that not only affects the environment but also has a detrimental impact on human health.
Therefore to address this issue and make producers responsible for their waste the policy for EPR was introduced. EPR responsibilities in India are limited to plastic and electronic Waste, which are governed by The Plastic Waste and The E-Waste Management Rules, respectively.
The MoEFCC defines EPR responsibility as the producer's obligation for environmentally sound product management to the product's end of life.
EPR essentially puts three liabilities on the extent to which, although not properly defined under the rules, have been specified in the definition. The three liabilities are:-
Physical responsibility is when the producer has the liability to oversee the proper management of product and their impact on the environment.
Economic responsibility covers the liabilities on the manufacturer to bear all or a portion of the expenses which are involved in proper management, which are to be paid directly by producers as a special fee.
Informative responsibility is put upon producers for their products by calling for the producers to give more knowledge on the environmental details of the products they are making.
Now when we are clear with the meaning of EPR let's focus on Procedure for EPR Authorisation
#cpcb provides EPR #certificate under the governance of the Ministry of Environment, Forest and Climate Change. This is the mandatory registration of those very producers, importers, and Bulk Consumers so that their activities can be properly monitored and regulated by the authorities.
The process involves completing the application with attached documents mandated by CPCB, submission of the application, inspection, and finally, grant of authorization.
Every Producer listed in Schedule 1 of the Rule must apply in accordance to Form 1 and submit it to the Central Pollution Control Board.
Documents required for EPR Authorisation are:-
Memorandum of Association.
Certification of Incorporation (CIN).
Company's PAN card.
Board Declaration for Authorized Signatory.
Required Documents for Proprietor
IEC (Importer Exporter Code)
Sole proprietor or KYC Authorized Signatory
Submit the rent or lease proof.
Validity of EPR Certificate
The EPR Certificate, issued for the first time, will be valid for one year, while the subsequent registration will have the validity of three years.
The renewal application has to be submitted by the Importers four months prior to the expiry of registration.
