With all that to think about, who can expect a bride to worry about a prenup the night before her wedding!? Of course, if things later go south, she might wish she had, as the wife in Simeone versus Simeone discovered.
Catherine Walsh married Frederick Simeone in 1975. She was a 23-year-old unemployed nurse. He was a 39-year-old neurosurgeon who made $90,000 a year and had $300,000 in assets. The evening before the wedding, Frederick’s attorney presented Catherine with a prenuptial agreement, stipulating that if the couple separated or divorced, she relinquished her right to alimony but would receive payments of $200 per week up to a maximum of $25,000. Catherine signed.
Catherine and Frederick separated in 1982 and divorced in 1984. Frederick paid support up to the $25,000 maximum, and then stopped paying. Catherine filed a claim for alimony in 1985. Catherine argued that, when she signed the agreement, she wasn’t adequately informed of her statutory rights to alimony and thus didn’t realize what she was giving up. A master upheld the validity of the prenuptial agreement. Catherine sued, but the Court of Common Pleas dismissed her claim, and the Superior Court affirmed the decision. Catherine appealed to the Supreme Court of Pennsylvania.
