Debs v. United States | 249 U.S. 211 (1919)

As the First World War raged on, American opinions sharply differed regarding whether the United States should enter the war. Congress answered that question by declaring war on Germany in April 1917. But many Americans still spoke out, and the United States Supreme Court discussed how much the federal government could punish continued opposition to the war in the 1919 case of Debs versus United States.

Shortly after declaring war, Congress passed the Espionage Act, which prohibited interference with military activities, including recruiting and drafting servicemen. Eugene Debs, a leader in the American socialist movement who had previously run for president, gave a speech in Ohio protesting American entry into the war. Without directly advocating that Americans refuse military duty or otherwise interfere with the war effort, Debs spoke sympathetically of other socialist activists who had been convicted of interfering with the war effort and suggested that the poor would suffer more in the war than would the wealthy. He also argued that capitalists had instigated the war.

Debs was charged in federal court with four counts of violating the Espionage Act. He was convicted of two violations of the act and appealed from the district court to the United States Supreme Court.
