What is a partition? A partition is a proceeding where the court orders a property to either be sold or divided between the owners. It's filed when at least one of the owners refuses to agree to divide or sell. NC attorney, Kirk Sanders, gives a short introduction in Partitions Part I.

So let's talk about what is a partition proceeding.

It's a proceeding that comes from Chapter 46A of statutes.

It's when two or more people own a piece of property, one of them doesn't want to sell it or one of them refuses to divide the property and now the others go, hey, I want to sell it or hey, I want my app, I don't want to share it.

And that's an action is a special proceeding in that the court will decide two things.

One, they'll determine the owners and the owners percentages.

And then two, and this is the big one, they'll decide can it be partitioned and kind?

So I've done 2 examples for you, One's 1/2 acre house.

You're going to solve all that house in half.

And when you do that, it's destroyed.

So they're going to say, no, this house on 1/2 acre, it's got to be sold and they'll go and appoint commissioner to sell property.
