A building contractor, Lateo, filed a claim against a nail manufacturer, ITW, saying that ITW's defective nails were used in the construction of chicken houses for Alabama farmers. Lateo claimed that if they were found liable for faulty construction, ITW should be responsible due to the warranty surrounding its products. ITW argued that it was improperly impleaded and that the claim was barred by the equitable doctrine of laches. Lateo failed to properly serve ITW until six months after the case was removed to the Middle District of Alabama.
