Sovereign citizens often cite various case laws to support their beliefs that they are exempt from the laws and regulations of federal and state governments. However, these cases are frequently misinterpreted or taken out of context. Below, I outline several prominent cases often misused by sovereign citizens and explain why they do not support their claims.
Marbury v. Madison (1803)
Misinterpretation: Sovereign citizens frequently cite Marbury v. Madison to assert that they can unilaterally declare laws unconstitutional and that they are therefore not bound by them.
Reality: Marbury v. Madison established the principle of judicial review, which empowers the judiciary to determine the constitutionality of laws. This authority is vested in the courts, not individuals. The case does not grant sovereign citizens the right to ignore laws or declare themselves exempt from government authority.
