Legality of the Threat or Use of Nuclear Weapons | 1996 I.C.J. 226 (1996)
World War Two was the first, and so far, the last time nuclear weapons were used in war. The devastation caused by the two nuclear bombs dropped in Japan led many people to argue that nuclear weapons should never be used again. In Legality of the Threat or Use of Nuclear Weapons, the International Court of Justice, or I C J, looks at whether international law principles prevent countries from using nuclear weapons.
The United Nations, or U N, General Assembly requested that the I C J answer a relatively simple question on its face: quote, “Is the threat or use of nuclear weapons in any circumstances permitted under international law?” unquote. This question not only asked about the legality of nuclear weapons but indirectly also put the issue of customary law and the authority of international judicial bodies, such as the I C J, into question.
Before deciding on the legality of nuclear weapons, the I C J first had to determine if it had the jurisdiction to answer the request for an advisory opinion by the UN General Assembly. The I C J can offer advisory opinions on legal questions. So, although the court acknowledged that there is a political element to the question posed by the U N, the question of whether nuclear weapons are permitted under international law is fundamentally a legal question.
