3 Tips for Dealing with Film Distribution Contracts
Film distribution contracts are a tricky thing to understand. If you want to learn how to protect yourself and your film, this video is for you. I'll share three tips for dealing with film distribution contracts.
What Is The Percentage Split?
The first thing to think about is what percentage goes to the sales agent or distributor, and what percentage goes to you, the filmmaker or filmmakers.
The standard commission for a film sales agent is about 25%. This commission can be negotiated up or down, depending on the situation. For example, if someone is offering you a commission higher than 60% (60 goes to the agent and 40 goes to you), it might be worth trying to negotiate this.
At the same time, there may be foreign sales when the distributor takes your film to market (when there are face-to-face events,) and those are expenses that cover the cost to print ads, posters, and other promotional materials. The distributor will deduct any of those expenses from the earnings.
What Is The Expense Cap?
It is essential to negotiate a deal that helps keep your expenses low. You and the distributor can avoid surprises and awkward conversations by establishing an expense cap. An expense cap sets the maximum amount that the distributor can spend without getting your approval.
What Is The Licensing Term?
How long is your film distribution contract term? It's a long term, like 15 years. Sometimes, this can be a little scary because you're signing over to the sales agent distributor for this long term. And what if it doesn't work out?
Do you know how do you get out of that contract? What if it doesn't work out on a short-term, you know, one or two years to three years? You know, something like that where you potentially have a life of the film after the contracts up, if you don't want to extend the contract with that sales agent, a distributor.
