A hostile work environment exists when unwelcome conduct is based on a protected characteristic such as gender, race, religion, or age. For example, sexual harassment can create a hostile work environment through repeated sexual comments, inappropriate jokes, intimidation, or unwanted touching. The behavior may be verbal, physical, or even written—like offensive emails, texts, or memes—and it can come from coworkers, supervisors, or even customers. What makes an environment “hostile” is when the conduct is severe or pervasive enough to create an intimidating or abusive atmosphere. To prove it, you must show either a single severe incident, such as a sexual assault, or an ongoing pattern of unwelcome behavior over time. The most important step you can take is to document everything—every comment, message, and incident.
