Hi, my name is Cory Dillinger here and I am an Associate at MPL who specializes in renewable energy land use.
With recent tax incentive changes, it is more important than ever for developers to push their projects to construction as fast as possible.
Here are a few tips from the trenches to help make that happen:
1. Review and respond to Land Development Plan comments as fast as possible. It can take municipal engineers quite some time to respond to each round of comments, so it is in a developer’s interest to turn around comments quickly.
2. Understand what legal agreements are needed up-front, so that this isn’t an item that is being finalized last minute. This means your Decomissioning Agreement, Operations & Maintenance Agreements, Developer’s Agreement, etc.
3. Apply for third-party permits as soon as possible. Most municipalities will not sign plans until they see a project’s NPDES permit or HOP permit.
4. Confirm timing of any financial security bonds early in the process. Some ordinances are not clear on the timing of these securities.
5. Stay in contact with the municipality throughout the process to confirm that expectations are set correctly.
