After the start of a full-scale war between Russia and Ukraine in February 2022, the European Union decided to relieve Ukrainians from the need to apply for asylum in order to obtain refugee status in one of the EU countries. They receive it automatically.
Germany accepted the largest number of Ukrainians fleeing military action in their homeland - more than a million people. Almost the same number of asylum seekers or protection seekers have arrived in Germany over the past three years from other countries
The German government's response to a parliamentary inquiry from the Left Party parliamentary group states that between July and December 2024, almost 20% of illegal migrants stopped at German borders were Ukrainian citizens.
At the same time, Ukrainians are in second place after Syrians who were not allowed into Germany.
"In order to optimally use the limited capacity for receiving refugees and asylum seekers in Germany, Ukrainian citizens who have already received protection in other EU countries and intend to move to Germany may not be allowed through the German border," the press service of the German Interior Ministry explains in response to a DW inquiry.
In doing so, the German Interior Ministry refers to Article 26 of the EU Directive "On Mass Influx" under number 2001/55/EG. According to this article, the relocation of a person who has received refugee status from one country to another must be carried out with the consent of the authorities of these states.
But if we are talking about a Ukrainian who has been living in one of the EU countries for a long time and wants to move to Germany for permanent residence, the letter from the Ministry of Internal Affairs continues, then he can do this by going through the procedure of obtaining a visa and residence permit in Germany.
The letter also further states that short-term trips of Ukrainian refugees from one EU country to another, the Ministry of Internal Affairs assures, are still possible:
"Almost all EU member states (including Germany) issue citizens of Ukraine who have been granted protection a document on a valid residence permit in the Schengen area.
With such a document, Ukrainians can enter, for example, from France to Germany for tourist purposes without a visa and temporarily stay here."
In order to avoid deception, during border control, a federal police officer finds out for what purpose and for what period of time a person is entering Germany.
"A person entering the country is obliged to provide evidence of the purpose and duration of the intended stay in Germany," added the press secretary of the German department.
If a person is being disingenuous and only pretending to be a tourist, and the German police officer has convincing suspicions on this account, then, according to the Ministry of Internal Affairs, such a person may also be denied entry into the territory of Germany.
