Buchanan v. Warley | 245 U.S. 60 (1917)
Before the fall of the separate-but-equal doctrine, segregation laws controlled nearly every facet of American life. A challenge to an ordinance separating residents by race began to erode this doctrine in Buchanan versus Warley.
In nineteen fourteen, Louisville, Kentucky, passed an ordinance to prevent conflict between races. Under the ordinance, African Americans couldn’t reside in any home where white people occupied more than half of the homes on the block and vice versa. The ordinance made an exception for domestic employees of different races than their employers.
Charles Buchanan, a white man, contracted to sell property to William Warley, an African American. The contract stated Warley planned to live on the property and, if any law prohibited him from living there, he wouldn’t be required to pay or receive the deed.
The block where the property sat had ten homes, and white people lived in eight of them, so Warley couldn’t occupy the property without violating the ordinance. Warley refused to pay or accept the deed.
Buchanan filed a civil suit seeking to force Warley to perform on the contract. The Kentucky trial and appeals courts found in favor of Warley. The United States Supreme Court heard the case.
