Should I Use the TM or R Symbol?

Here's another Trademark Health Tip from the Trademark Doctor.
People often ask, "Do I use the "TM" symbol, or the "R" symbol on my trademark??"
Well, it depends.
The "TM" symbol is used for trademarks that are not registered.
This could be because you haven't bothered to register the trademark -- which the doctor does not recommend.
Or it could be because you applied to register the trademark, but you haven't' been granted the registration just yet.
Either way, the TM symbol puts others on notice that you are using that word or logo as a trademark.
The "circle R" symbol is used with marks that have been registered by the Patent and Trademark Office.
This means that the owner of the mark has applied for and been granted the exclusive right to use that mark on his goods or services here in the United States, and that the registration is on file with the Patent and Trademark office.
As long as the owner of the mark keeps using the mark in commerce, his trademark rights continue.
