Question of the Day: If I approach people on a street and ask them a question for a YouTube channel, do I have to ask them to sign a video consent/release form? Or do I have to ask them on video if they give me permission to post this video on YouTube?

The real question is if the person you put on your video ever challenges the legality of actions, what do you have to support your position that they gave you permission to do it? If you have it on video – their face and voice – it will be difficult for them to dispute your assertion that they authorized the use of their image. If you don’t get it on video, a signed consent form is beneficial because they’re granting permission with their name and signature. The other benefit of having a signed consent form is it can contain additional provisions, like a dispute resolution clause.

If legal questions were easy, we wouldn’t need lawyers.
