Does adverse possession apply to rental property?
Generally, a tenant cannot claim the adverse possession of a property when there has been a lease or rental agreement between the landlord and tenant. But if the lease expires or the landlord has defaulted on any information in the agreement, the tenant can claim ownership after 12 years of possession.
Tenant rights after 10 years in India:
There is nothing in the law that states as any tenant can claim rights on the property after 10 years. If you have signed an agreement of 11 months or with the tenants, the tenant cannot claim any rights to the property as per the law.
What is the 12 year tenant rule in India?
Continuous Possession: Uninterrupted or continuous possession of the property for 12 years allows the tenant to claim ownership rights. Similarly, if the owner has been away from the property for 12 years, the tenant can claim possession.
