Here we have discussed various constitutional provisions and judicial rulings respecting amendment of fundamental rights detailed in the Constitution. Initially, the Constitution provided that the Parliament cannot amend these rights. However, the Parliament itself made some amendments in this regard which were challenged in the Supreme Court. The Supreme Court pronounced different rulings in this regard from time to time under several renowned cases like Golaknath, Kesavanand Bharati, Minarwa Mills etc. The latest position in this regard is that any amendment in the fundamental rights must not infringe the basic structure of the Constitution as decided by the Supreme Court.
