This is the third and therefore THE GRAND FINALE of a series of reaction videos in which I explain the background to the dispute with Moody and Hagen Amstep regarding the "ghetto Porsche" story.

I'm making these reactions because of the many questions from my community about this conflict.

In this part, I'm responding to the statements from YouTubers Hagen Amstep and Leon Moody.

Many of you have requested in the comments that I next address the events between Moody, Maeximiliano, and Eiko P at the H&R Trackday event at Billsterberg 2022.

Current legal opinion on the creation of so-called "reaction videos"

In general, videos (referred to as "moving images" in the law) are protected under Section 95 of the German Copyright Act (UrhG).

Copyright law protects authors from the exploitation of their work by third parties. Copyright holders should generally have the right to decide who works with their material and potentially even generates revenue from it.

However, the special feature of so-called reaction videos is that engaging with the content of a video is difficult or even impossible if it cannot be displayed. For this case, the law provides for a so-called "right to quote." In the case of a legitimate application of this right to quote, the principle applies that copyright holders must permit the use of their videos in this exceptional case. Thus, the use of someone else's video is generally permissible if the video serves as evidence or a basis for discussion.

This exceptional case is regulated in Section 51 Paragraph 1 Sentence 1 of the German Copyright Act (UrhG) as follows:

"The reproduction, distribution, and public performance of a published work for the purpose of quotation is permissible, provided that the extent of the use is justified by the specific purpose."

For this to apply, the reaction video must engage with the content of the original video used. If the critical engagement with the content of the video shown predominates, the video falls under the right to quote under copyright law. According to the Higher Regional Court of Cologne, this is the case if the person reacting to the video they are using establishes "an internal connection with their own thoughts" in their own reaction video.

The person reacting must record the content of the video and comment on it. In addition to engaging with the content, the law requires that the use "is justified in its extent by the specific purpose."

This means that the video may only be used in its entirety if the person reacting actually responds to the whole video.

This is therefore not the case if they only react to a small part of the video and then use the rest without comment. In this case, the quotation would take up too much space and thus exceed the limits of Section 51 of the German Copyright Act.


The person reacting must record the content of the video and comment on it. As a general rule, more than half of the reaction video must consist of video footage of the person reacting in order for the use of Section 51 Paragraph 1 Sentence 1 to be justified. Furthermore, the source from which the quote originates must always be indicated. This will usually be the channel on which the video was first uploaded.
