Polity: Legislature : Case for abolishing Rajya Sabha- Article 80 of the Constitution - composition of the Council of States. Some of the constituent assembly members opposed the idea of Rajya Sabha
e.g. Lokanath Misra (Odisha) and Shibban Lal Saksena (UP). Their arguments were- 1) there is no real need for the second chamber, nor do I think that it will serve any useful purpose. 😥 second chambers are out of date😥 Its creation will only result in so much waste of public money and so much waste of time 😥 in the Upper Chamber we have twelve nominated members; who will never seek the vote of the people, yet they can become ministers also. this is a most undemocratic aspect of our Constitution. 😥 not a true representation of a particular state due to horse-trading, suitcase-culture of buying tickets and big leaders parachuting. 😥Uttar Pradesh or Maharashtra that is two-House while West Bengal and Tamil Nadu have only 1 house. If State governments can run without second house then why can’t union govt? 😥Basic Structure doctrine enunciated by the Supreme Court in Kesvananda Bharti holds parliamentary democracy to be basic structure. It doesn’t say not bicameralism is required for basic structure. ✋Counter-Arguments: 😍 Rajya Sabha will have a sobering effect on the decisions of the Lower House 😍 Rajya Sabha is a continuous House as opposed to the Lok Sabha that gets mandatorily dissolved every five years. 😍 meritorious person who cannot win Lok Sabha election can still enter the legislature. ECI Reforms: Chief Election Commissioner Rajiv Kumar asked the Law Ministry to implement following reforms 1) one person can contest election from one seat only. To save money / resources of ECI 2) ban opinion & exit polls 3) linking of Aadhaar with voter IDs 4) allowing four qualifying dates for eligible people to register as voters 5) Power to Deregister the political parties which are not submitting the required data documents to election commission in timely fashion. 6) Nuisance of
'registered unrecognised political parties' (RUPPs) - over 2000 such parties mostly set up for evading the income tax. 😥 challenges: 1) Section 29A of the Representation of the People Act, 1951 empowers ECI to register political parties However, there is no constitutional or statutory provision that gives power to the EC to deregister parties. (2) Need Amendment to Section 33(7) of the Representation of People Act, 1951 to restrict the number of seats a candidate can contest from. But who will bell the cat? (चुनाव आयोग द्वारा विविध सुधार)
