Spousal Privilege - Can the State Make Your Spouse Testify Against You?
Can the state make my wife or husband testify against me in a criminal case? In Texas, the state usually can't make your spouse testify against you in a criminal case. There are exceptions, though. The biggest exception is in a family violence case, they usually can make your spouse testify against you. Your spouse can also testify against you if they want to, even if you don't want them to testify. In some cases, you may want them to testify and you can call your spouse as a witness. If that happens, the state will be able to cross-examine them.
