Today, we're exploring the picturesque location of San Marino, nestled within Italy. San Marino, renowned for its beauty, is also known for its high real estate rental costs. This sets the stage for our discussion: Is it legal to rent property, residential or commercial, to foreign nationals without residency permits?

Recently, one of my clients had an unsettling encounter with a real estate agent who claimed that renting to a foreign expatriate without residency was not just illegal, but a criminal offense. This misconception stems from Italy's criminal code, which penalizes aiding illegal immigration. However, my client, currently in the process of obtaining residency, is not in an illegal status.

Let's clarify: Assisting individuals who are in various stages of the residency process-applying, renewing, awaiting approval-does not constitute aiding illegal immigration. Italy's law allows individuals in these stages to seek housing legally.

Reciprocity of rights ensures that individuals from countries granting Italians similar rights can rent property in Italy. Hence, foreigners can lease property in Italy before acquiring a type D visa. However, landlords should exercise caution if a tenant intends to stay beyond 90 days without proof of residency application.

Understanding the nuances of rental agreements in Italy is essential. Whether it's a short-term lease or a multi-year agreement, various legal options exist. Remember, seeking legal advice is prudent if uncertainty arises.
