ADA Litigation Discussion
President George H.W. Bush signed the Americans with Disabilities Act into law in 1990. ADA Title III mandated that all establishments open to the public must be accessible and make "reasonable adaptations" in order to do so, as well. Accordingly, those who advocated for its adoption chose to forgo the creation of an official federal agency to monitor or enforce it as is done by the Drug Enforcement Administration (DEA) and Immigration and Customs Enforcement (ICE). According to the legislators, instead of relying on government agencies, handicapped persons should rely on the courts to enact ADA laws.
