OSHA promulgated the HAZWOPER regulation 1989. OSHA did so as they were mandated by the U.S. Congress to develop regulations that protected workers from exposures to hazardous substances. While Congress gave a lot of leeway to OSHA to write and enforce HAZWOPER regulations. Congress did provide one stipulation for OSHA to include in its regulation. Each impacted worker must have specific time requirements associated with their training. For example, a minimum of 40, 24 and 8 hours is required based on a workers job classification. These training durations cannot be altered by OSHA as Congress imposed this requirement.
