On October 22, 2022, in the Village of Cashton, Wisconsin, an on duty officer noticed a vehicle that did not have functioning registration lamps for their license plate. After briefly following the vehicle, the officer noted that the vehicle had passed the same street twice in a short period of time. Due to the odd driving behavior and lack of functioning registration lamps, a traffic stop was initiated.
The driver, identified as Mark, was initially compliant and courteous. After a few questions from officers, Mark became agitated. Mark was asked if he would complete FST's. He agreed but stated that he couldn't walk like the officers wanted him to due to being old and that he had allergies.
Mark Became more agitated and eventually was decentralized by officers due to his unwillingness to cooperate. Eventually he was arrested and placed in the back of a squad car.
Mark's vehicle was searched but nothing of note was found. Mark was taken to the hospital for a legal evidentiary blood draw after a warrant was issued. He continued to be uncooperative in the hospital however, eventually officers and hospital staff were able to get a blood sample.
The blood draw resulted in a BAC of 0.199. Mark was charged with Resisting or Obstructing an Officer, OWI 2nd, Operating with Prohibited Alcohol Concentration 2nd and Operating a vehicle without Registration Lamps. He was found guilty of Resisting or Obstructing an Officer and OWI and sentenced to 23 days in local jail, he also had his drivers license revoked for one year.
