How to use GSCOP? - to put it simply - hopefully never!
My name is Darren and you're at the home of Sticky Learning - MBM - Trainers to the UK Grocery Industry and experts in making learning stick.
It is almost never in a suppliers' best interest to invoke a formal GSCOP complaint against one of the big and powerful 10 named supermarkets covered by the Code.
Why? - well imagine this scenario - you are walking home late one night through a dodgy part of town and you get mugged for £100 out of your purse/wallet - what do you do? - call the police? - yes!
What do you do when a big retailer 'mugs' you for thousands of pounds as a result of breaching GSCOP - you want to report it right? - Yes! - so you go to the 'police'? - NO! - under the GSCOP 'rules' you have to go back to and complain to the very people that mugged you!!
Yes - unbelievable but true - if you have a complaint with one of the 10 named supermarkets under GSCOP your first port of formal complaint is back the very supermarket that first mugged you!
Little wonder then that there have been fewer than 5 formal complaints in the 8 years since GSCOP came into force.
In practical terms all the 10 named supermarkets have put pretty good and rigorous systems and processes in place to stop some of the worst practices of the past. Such as retrospective claims, inordinately long payment terms and random debits for short load deliveries, so things would have to go very wrong for any supplier to ever need to formally invoke the Code.
However, you do need to understand how to use GSCOP and more importantly understand how you can use elements of the Code to your advantage to do better deals when negotiating with your customers.
