Understanding a No Contact Order

If you've been arrested for domestic violence in Florida, it's almost certain that the judge ordered no contact with the alleged victim at your first appearance. What that means is you cannot have any personal or phone contact or third party contact with that victim while the case is pending. So that means that you can't pick up the phone and call them, you can't go to their house and try to talk to them about the case, and you can't tell anybody else to send them a message for you. If you do any of those things in violation of the no contact order a warrant will be issued for your arrest And you will be held on zero bond in the jail until the case is resolved so If you have one of those no contact orders pending and you'd like to have contact with the victim It's possible to have your defense attorney go to the judge and ask for contact However at the hearing to have that no contact order lifted you've got to understand that the judge is going to put the victim under oath and is going to ask them about the case. So you risk creating more bad testimony against you in the case by asking for the no contact order to be lifted. So when you have a domestic violence charge pending, you need to have patience because there's going to be an extended period of time where you might not be able to have contact with your loved one, even if they don't want to prosecute or press charges. But having patience and following those rules will keep you in the best position to have the case resolved in your favor.
