Police Arrest Em For Partying Too Hard On Boat

A Florida Fish and Wildlife Officer, in full agency uniform and a marked patrol vessel, conducted a safety inspection on Little Lake Conway in Orange County, Florida. Observing a vessel occupied by multiple people, the officer approached to check for safety equipment. Noticing a strong smell of alcohol from the vessel, the officer tied the patrol vessel to theirs and requested life jackets from the driver, later identified as [REDACTED].
The driver was slow to respond and had difficulty standing, weaving back and forth. The driver retrieved five personal flotation devices (PFDs) from a hatch on the vessel floor and began to sit while other occupants found four more life jackets in another compartment. The officer insisted the driver retrieve the safety equipment alone. The driver, almost stumbling, continued searching for more PFDs under the direction of a female passenger. When asked to show a fire extinguisher, the driver instead produced a first aid kit.
When questioned about alcohol consumption, the driver admitted to having "two" drinks. The officer requested the driver step onto the patrol vessel for Standardized Field Sobriety Tasks (SFSTs) and put on a PFD, which the driver incorrectly buckled. A female passenger assisted in properly securing it.
During SFSTs, the driver provided the following responses:
• No physical defects or disabilities.
• Had surgery on his eyes.
• Recently recovered from a cold.
• Not under a doctor’s care.
• Taking DayQuil.
The officer noted the driver’s eyes were glossy and watery. Further examination revealed:
• Lack of smooth pursuit in eye movement.
• Distinct and sustained nystagmus at maximum deviation.
• Onset of nystagmus prior to 45 degrees.

Finger to Nose Task:
• Unable to follow instructions.
• Moved head during the task.
• Hesitated, missed the tip of the nose, did not bring hand down (multiple counts).

Palm Pat Task:
• Unable to follow instructions.
• Rolled hand instead of flipping.
• Counted from one to sixty-four instead of one, two.
• Failed to increase speed.
Total Clues: 4
Hand Coordination Task:
• Improper touch (did not start at chest).
• Improper return (did not return fists to chest).
• Did not perform the task as instructed.
Total Clues: 3
Based on observations and the driver’s poor performance on SFSTs, the officer placed the driver under arrest for boating under the influence.
