This video is about trends in New York State DWI defense. Late in December 2018 Utah passed a .05 BAC (blood alcohol concentration) DUI. That means that legal intoxication is only a few drinks.
New York State will likely move to .05 in the future? But New York would have to revise a great many DWI and DWAI laws to have a new lower threshold of .05.
Right now .05 BAC in New York means you are presumptively NOT impaired or Intoxicated.
If NY passes a new .05 DWI law, what will be the new New York impaired level?
Would it then be a .03 BAC DWAI?
Maybe just one strong drink means you can no longer drive a car in New York legally?
New York Judges, prosecutors, alcohol evaluators, and probation officers always check BAC levels when making recommendations on DWI cases. Your DWI BAC needs context and explanation, higher levels need to be defended differently than low level BAC DWIs.
