In a gestational surrogacy, the intended parents (IPs, or parent, IP) contract a woman (surrogate or carrier) to gestate an embryo and deliver their child for them. This embryo is created through in vitro fertilization with their own zygotes or a combination of theirs with donor egg and/or sperm. This embryo has no genetic relationship to the surrogate, who is paid for her time and effort by the IPs.

He also describes choice of law: which laws pertain when the IPs, carrier, and clinic are all located in different states.
