Roe v. Wade Overturned: How Does it Affect IVF? (Part 1) | Northeast Assisted Fertility Group
Sanford Benardo, an attorney specializing in assisted reproduction law and President of the Northeast Assisted Fertility Group (NAFG), and Kathy Benardo, the egg donor coordinator at NAFG, discuss the implications for assisted reproduction technology, both actual and potential, of the Dobbs decision.
The Dobbs vs. Jackson ruling stated that the right to abortion is not guaranteed in the constitution. Although the ruling does not mention in vitro fertilization, it could open the door for restrictive laws in the future. This decision has caused worry and even panic among some IVF patients, as assisted reproduction technology is on the spectrum of reproductive rights.
In this part one, Sanford and Kathy focus on the abortion clause of the surrogacy contract: why this clause is included and why it has never been used, and if this will change which states where surrogacies can occur.
