About halfway through the pregnancy, the intended parents’ lawyer seeks a court order of parentage, typically a pre-birth order, that establishes the intended parents as legal parents of the child. The hospital staff is informed of the surrogacy ahead of time to provide extra support for all parties during the labor and delivery.
