I wasn't read my rights! This is a comment I hear at least once a week. In this video I am going to explain what your Miranda Rights are and how they work.

The short version is this, if you are being investigated for a crime, Miranda does not apply, meaning it does not need to be read to you.

Miranda is triggered once you are in police custody or under arrest. Once that happens, if police want to ask you questions they have to tell you what your Miranda Rights are first. (If they do not want to ask you any questions they do not have to read you the rights).

If police arrest you, and do not read you your rights, then at trial, any answers you gave to the officer's questions cannot be told to the jury.

The easiest way to avoid having your statements used against you is not to make any! Keep your mouth shut and don't talk to the police when they are investigating you for a crime.
