Arrested for drinking and driving and you weren’t read your Miranda Rights? Does it matter?

Miranda Rights are warnings that need to be read to you after you have been arrested if police are going to question you.

If Miranda is not read to you and you are questioned, then it prevents your statements from being used against you in court.

In DUI cases, most of the evidence against you is obtained during an investigation and before you are arrested. This means that Miranda does not apply. Also, most of the evidence is also not a statement but instead, things like smells, your balance, how you appear, what your blood alcohol is. Miranda won’t help you here either.

Miranda might come into play if an officer needs to get you to admit you were driving and waits to ask you after he makes the arrest.
